Terms and Conditions of Sale

1. Purpose
These Terms and Conditions of Sale (hereinafter “T&Cs”) govern the contractual relationship between any user (hereinafter “the Client”) placing an order on the website [www.afero-works.com] (hereinafter “the Platform”) and the artisan Afero Works, a musical instrument maker based in Ghana, West Africa.
The Platform acts solely as a technical intermediary, providing an online interface (e-shop) for browsing, ordering, and transmitting payment and shipping information.
Products are crafted, sold, and shipped directly by Afero Works, an independent artisan. The Platform does not sell any product in its own name.
2. Role of the Platform
The Platform facilitates the connection between the Client and the artisan Afero Works, by enabling:
Browsing and ordering through the website,
Secure payment via Stripe,
Forwarding order and delivery details to the seller.
The Platform collects payment on behalf of the artisan and receives a fixed intermediary commission.
The Platform is not the legal seller and cannot be held liable for any issue related to product quality, delivery, or compliance.
However, in the event of a dispute concerning the product, shipping, or non-conformity, the Client may hold Afero Works directly responsible, as the official seller.
The Platform may, at the Client’s request, act as a mediator, to facilitate dialogue and support an amicable resolution.
3. Orders and Payment
Orders are placed online through the Platform. Payment is processed via Stripe, a secure third-party payment provider.
The price displayed for each product includes:
The price set by the artisan,
Shipping fees (calculated automatically at checkout based on the destination),
A fixed intermediary commission for the Platform.
The full amount is collected by the Platform and then divided between the artisan and the Platform.
The order is confirmed upon successful payment.
4. Invoicing
The Client will receive an official invoice issued by Afero Works, sent via email after confirmation.

5. Delivery
All products are shipped directly by Afero Works from Ghana.
Estimated delivery time: 2 weeks depending on the destination.
Specific delivery estimates are listed on each product page.
Shipping fees are automatically calculated during checkout based on the country of delivery.

Clients are encouraged to contact the Platform before placing an order if they wish to arrange a faster shipping method than the standard timeframes provided.
Customs Duties and VAT
As the goods are shipped from a non-EU country, the transaction is considered an import under European regulations.
As such:
No VAT is applied at the time of purchase,
Customs duties and/or import VAT may apply upon delivery, depending on the local legislation,
These fees are the Client’s responsibility and are not covered by the Platform or Afero Works.
The invoice will include the note:
“VAT not applicable – Sale outside the European Union”
or
“Exemption under Article 44 of Directive 2006/112/EC”
Express Delivery
An express delivery option may be available upon request, for an additional fee.
Clients are encouraged to contact the Platform before placing their order if they would like a faster shipping option than the standard timeframe.
6. Right of Withdrawal and Returns
Due to the artisanal and often made-to-order nature of the products, no right of withdrawal applies once the order is confirmed, except in the following cases:
The product is clearly non-compliant with the description,
The product is damaged upon delivery (photo proof required).

The Platform may support the Client as a facilitator but is not responsible for return processing or refund decisions, which are handled by the seller.
7. Liability
The Client acknowledges that:
The Platform is neither the manufacturer nor the seller of the products,
The full legal and commercial responsibility lies with Afero Works, the seller,
The Platform acts only as a technical intermediary and website developer.
In case of any defect, delay, or non-conformity, the Client may contact and hold Afero Works liable, using the contact information provided on the official invoice.
The Platform may intervene as a mediator to assist with communication and help find a resolution, but does so without any legal obligation.
8. Intellectual Property
All content on [YourWebsiteName.com] (structure, texts, visuals, photos, source code) is protected by intellectual property laws.
All instruments and designs remain the sole property of Afero Works.
9. Data Protection
The Platform collects only the data necessary for:
Processing orders,
Transmitting information to the seller for shipping,
Communicating with the Client.
This data is kept secure, never sold, and is processed in compliance with the General Data Protection Regulation (GDPR).
Clients can request access, correction, or deletion of their data at any time.
10. Applicable Law
These Terms and Conditions are governed by Belgian law, particularly with regard to the Platform’s role as a technical intermediary.
For all matters relating to the sale, product responsibility, and delivery, Ghanaian law may also apply, as Afero Works is the official seller.
Any dispute shall first be subject to a good-faith attempt at amicable resolution.
The Client acknowledges that no legal action may be brought against the Platform, which is not a party to the sale.
All claims must be addressed to the seller: Afero Works.
